By accessing https://ausbeds.com.au, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you disagree with any part of these terms, you must not use our website or purchase our products.
Ausbeds reserves the right to modify these Terms of Service at any time. We will update this page with any changes that become effective immediately upon posting. Your continued use of our services following any modifications constitutes acceptance of those changes.
2. Website use restrictions
Permitted use
Our website is provided for your personal use to browse and purchase Ausbeds products. You must use our website in compliance with all applicable laws and these Terms.
Prohibited conduct
When using our website, you agree not to:
- Circumvent or disable any security features or access restrictions
- Use automated systems or software to extract data from our website
- Transmit viruses, malware, or any harmful code
- Infringe upon the intellectual property rights of Ausbeds or third parties
- Collect or harvest personal information about other users
- Use our website for any unlawful, fraudulent, or malicious purpose
- Interfere with or burden our network infrastructure
- Misrepresent your identity or affiliation with any person or entity
3. Intellectual property rights
All content on this website, including text, graphics, logos, images, audio clips, and software, is the property of Ausbeds or its content suppliers and is protected by Australian and international copyright laws.
You may view and print pages from our website for personal, non-commercial use only. This permission does not constitute a transfer of ownership and is subject to the following restrictions:
- You must retain all copyright and proprietary notices
- You may not modify, distribute, or publicly display the content
- You may not use the content for commercial purposes without our written consent
Any unauthorised use terminates the permission granted herein and may violate applicable laws.
4. Product purchases and payments
Orders
All orders placed through our website are subject to acceptance by Ausbeds. We reserve the right to refuse or cancel any order for any reason, including:
- Product availability
- Errors in product or pricing information
- Suspected fraudulent activity
- Violation of the Terms of Service
Pricing
All prices are displayed in Australian dollars (AUD) and include GST where applicable. We strive for accuracy but reserve the right to correct any pricing errors. If a pricing error occurs, we will notify you and give you the option to proceed with the corrected price or cancel your order.
Payment
Payment must be made in full at the time of purchase through our approved payment methods. By providing payment information, you represent that you are authorised to use the payment method and that the information provided is accurate.
5. Delivery information and risk
Delivery services
We offer various delivery options to Sydney, Brisbane, Melbourne and Canberra metropolitan areas. We can also deliver to addresses near the major highways that connect Sydney with Brisbane, Melbourne and Canberra. Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control.
Important delivery requirements
Customer assistance
- Standard Sydney deliveries include ONE driver only
- Customers must be able to safely assist with carrying the mattress
- If you cannot assist (due to stairs, physical limitations, or safety concerns), you MUST book a two-person delivery
- Mattresses are heavy. A typical queen-size mattress weighs 30-70kg
Legal requirements
- Two-person delivery is legally required when:
- Stairs are involved, and the customer cannot safely assist
- The customer has disclosed that they cannot help with lifting
- Safety concerns prevent customer assistance
Delivery process
- We'll contact you to arrange a delivery time
- Someone must be present to receive delivery
- Driver(s) will bring the mattress to your front door or building entrance
- Additional services (room placement, old mattress removal) are available on request
Title and risk
When you own the product
Once we successfully process your payment, you become the legal owner of the products.
Delivery responsibility
Once products are delivered to your specified address, you accept responsibility for their care and any risk of loss or damage. We recommend inspecting your mattress upon delivery and contacting us immediately if there are any issues.
6. The Ausbeds adjustment period and returns
Our commitment to your comfort
We understand that finding the perfect mattress requires time and adjustment. Our modular design allows us to work with you over 3-9 months to achieve your ideal comfort level through our unique adjustment system.
The 3-9 month adjustment period
Initial period (0-3 months)
- Your adjustment period begins on the delivery date
- Includes 2 FREE component swaps to fine-tune your comfort
- We work with you to find the right spring firmness and configuration
- Minimum 30-day retention required before requesting a return
Extension options
- First extension (3-6 months): Contact us before your 3-month deadline to extend
- Final extension (6-9 months): Request before your 6-month deadline for final extension
- Extensions are NOT automatic - you must contact us before each deadline
How adjustments work
Our mattresses offer over 12 different configurations. Common adjustments include:
- Swapping springs for firmer or softer options
- Adding or removing foam/latex layers
- Changing between Cloud and Aurora configurations
- Adjusting from Cloud 5 through Cloud 10 firmness levels
Return process
If the mattress isn't right after trying adjustments:
- Contact sales@ausbeds.com.au within your active adjustment period
- We'll ensure you've tried appropriate adjustments first
- If a return is approved, we'll arrange collection
- Return fee: $90 (separate from any delivery charges)
Refund terms
- Full mattress price refunded minus original delivery fee and $90 return fee
- Refunds processed within 14 business days of receipt
- Returned via original payment method
- We reserve the right to refuse returns showing damage or misuse
7. Warranties
10-year mattress warranty
All Ausbeds mattresses come with a 10-year warranty from the purchase date.
What we cover:
- Springs softening or losing support
- Foam or latex layers deteriorating prematurely
- Structural defects
- Manufacturing issues
Our no-hassle warranty process:
- NO proof required - no photos of body impressions or ruler measurements
- Simply tell us the problem and we'll sort it out
- We may visit your home to assess and fix issues on-site (For Sydney metro: $2/km from Marrickville; for all other areas, please contact us)
- Most issues are solved by swapping springs to match your body weight
Spring replacement policy:
- Spring replacements are FREE - you only pay delivery for delivery (For Sydney metro: $2/km from Marrickville; for all other areas: please contact us)
- The most common fix for "sagging" is replacing springs with firmer ones
- We've never seen latex sag - issues are typically springs or bed base
Component replacement pricing (prorated by age):
Cooper foam layers:
- Single: $70
- King Single: $80
- Double: $100
- Queen: $120
- King: $150
Aurora/Cloud latex layers:
- Single: $350
- King Single: $400
- Double: $500
- Queen: $550
- King: $600
Important notes:
- Check your bed base - flexible slats often cause apparent "sagging"
- We'll help fix base issues during service visits
- Warranty applies to domestic use only
- Does not cover commercial use, normal wear, staining, or damage from misuse
Australian Consumer Law
Nothing in these Terms limits your rights under Australian Consumer Law. Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
8. Limitation of liability
To the maximum extent permitted by law:
- Ausbeds provides the website and products "as is" without warranties of any kind beyond those required by law
- We are not liable for indirect, consequential, or incidental damages
- Our total liability for any claim is limited to the amount you paid for the relevant product
- We are not responsible for delays or failures due to causes beyond our reasonable control
These limitations do not apply to liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
9. Indemnification
You agree to indemnify and hold Ausbeds, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your breach of the Terms of Service
- Your use or misuse of our website or products
- Your violation of any law or third-party rights
10. SMS communications
Consent to receive messages
If you opt in to receive SMS communications, you consent to receiving informational and promotional messages from Ausbeds. Message frequency varies. Message and data rates may apply.
Opting Out
You may opt out at any time by:
- Replying STOP to any SMS message
- Contacting sales@ausbeds.com.au
- Updating your preferences in your account settings
We will process opt-out requests within 48 hours.
11. Privacy and data protection
Your use of our website and services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.
12. Third-party links
Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of these external sites. Your use of third-party sites is at your own risk.
13. Dispute resolution
Initial resolution
We encourage you to contact us first with any concerns at sales@ausbeds.com.au. Most issues can be resolved quickly through direct communication.
Formal disputes
If we cannot resolve a dispute informally, you agree to attempt resolution through mediation before pursuing litigation. Any legal proceedings will be conducted in the courts of New South Wales, Australia.
14. General provisions
Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Ausbeds regarding your use of our website and purchase of our products.
Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.
Assignment
We may assign our rights and obligations under these Terms to any successor or affiliate without your consent. You may not assign your rights without our written permission.
International orders
We currently only deliver within Australia. International customers accessing our website do so at their own risk and are responsible for compliance with local laws. Any orders placed by international customers will be refunded.
